Model Easements

When using a model easement, please review the associated commentary!  The commentary provides optional and alternative easement provisions as well as guidance in applying the model to particular circumstances.

Contact the Pennsylvania Land Trust Association to submit suggestions for future editions. Please also consider sending the Association a testimonial.

Pennsylvania Conservation Easement

Used by most land trusts, municipalities and landowners in Pennsylvania, the model is continuously tested and regularly reviewed for potential improvement.

Trail Easement Agreement

Secures public access for hiking, biking and other trail uses while respecting the needs of the landowners providing the access. Used widely in and outside of Pennsylvania.

Grant of Trail Easement

The Grant of Trail Easement is brief -- one page (exclusive of signatures) as compared to nearly five for the Trail Easement Agreement. The Grant of Trail Easement is provided in recognition that brevity is sometimes the paramount concern of landowners. If establishing certainty as to landowner and holder rights and responsibilities and other trail matters is of significant concern, the Trail Easement Agreement is the better choice.

Fishing Access Agreement

Ensures responsible fishing opportunities for the public and conservation of riparian areas while keeping a property in the control of the landowner.

Water Quality Improvement Easement

Secures long-term access through and to property for the purpose of remediating the effects of abandoned mine drainage.

Riparian Forest Buffer Protection Agreement

A single-purpose tool, designed for protecting a narrow ribbon of land along a waterway to protect water quality.
