Governor Rendell files Request for Rehearing

Rehearing Request

On November 2, 2007 Governor Rendell’s administration filed a Request for Rehearing with DOE on the Mid-Atlantic NIETC designation order. The state cited the following reasons for its request:

  • The Federal Powers Act requires that any corridor be narrowly drawn and limited only to those areas that are experiencing electric energy transmission constraints or congestion. In many parts of the 52 Pennsylvania counties affected, that is not the case. · The Department of Energy, or DOE, failed to consider any alternatives prior to designating the corridor.

  • DOE never prepared an environmental impact statement prior to making its decision as required in the National Environmental Policy Act. · The federal government neglected to consult with the commonwealth in a timely fashion while studying transmission congestion, and failed to consider the state’s comments.

  • The DOE abused its discretion in choosing to designate the corridor.
March 6, 2008 - DOE Denies Request for Hearing

On December 3, 2007, the Department of Energy granted the requests for rehearing. No new comments are being taken. The Department will issue new order(s) based upon the matters raised in the requests for rehearing.

Docket No. 2007-OE-01 Order Granting Rehearing for Further Consideration

The Request for Rehearing and Stay of the Designation Order was filed with the Department of Energy regarding its proposed Transmission Corridor for Mid-Atlantic in November 2007. The Request was filed by the Southern Environmental Law Center, with PALTA joining as one of the 19 rehearing applicants. The applicants argued that the Department failed to comply with existing federal statutes, erred in its analysis of congestion cost data, and designated the Corridor in a manner inconsistent with the intent of Congress.
